It’s not often that the courts toss out FCC rulings. The last time this happened was - never. That all changed with yesterday’s possible precedent-setting ruling by the Third Circuit Court which overturned the FCC’s indecency fine of CBS, imposed for the Janet Jackson wardrobe “malfunction” at a halftime performance at Super Bowl XXXVIII 4 1/2 years ago…
First, it’s important to know why the fine was overturned. The court said the following, “(The FCC) acted arbitrarily and capriciously” in issuing the fine for the fleeting image of nudity. (Janet’s Ta-Ta was exposed for a whole nine-sixteenths of a second.) And here’s the real “why” - the court found that the FCC deviated from its nearly 30-year practice of fining indecent broadcast programming only when it was so “pervasive as to amount to ’shock treatment’ for the audience.” That explanation courtesy of Chief Judge Joseph Scirica. The judge went on to add, “like any agency, the FCC may change its policies without judicial second-guessing but it cannot change a well-established course of action without supplying notice of and a reasoned explanation for its policy departure.“ End of story…
I was at that Super Bowl game, sitting 50 yards away from the incident. This was the crowd reaction to the “malfunction” - , as in zip, zilch, nada and nothing - not even a murmur. Half the crowd had headed for the restrooms but I decided to let the crowd go first before making the trip. I saw that “malfunction” and figured that it was part of the act. So did the rest of the crowd. The overturning of the fine was the correct decision. The FCC imposed the $550,000 fine on CBS because of the public furor that was fanned by the media. End of story…

WRKS (Kiss) will scream bloody-murder if they don’t repeat as New York’s number-one rated Arbitron station when diaries are replaced by PPM’s this fall. WRKS pulled a 4.9 to finish number one in the spring Arbitron but ethnic stations haven’t fared well when measured by Portable People Meters.
