Internet Agreement Is Limited…

Those applauding the new DiMA agreement with the recording industry as the savior of Internet Radio are mistaken.  This agreement, which still must be approved by the Copyright Royalty Board (CRB), only covers streaming and other limited downloads.  It does not cover royalty rates for physical music products or permanent downloads.  The CRB will issue a ruling on those rates by October 2…

And how does it affect satellite and cable?  It doesn’t.  Royalty rates for satellite and cable providers are determined by a four-factor test set up by the 1976 Copyright Act.  In 1998 Congress updated that law and gave authority regarding Internet royalty rates to the CRB.  So before you drink the same Kool-Aid that the Digital Media Association, National Publishers Association, RIAA, Nashville Songwriters Association and the Songwriters Guild of America are chug-a-lugging, think again.  This deal will help those parties affected under this new agreement but not everyone…
